In summary, at that time Campelo Filho issued a resolution authorizing the activity of bingo gaming companies in the state of Paraná which, according to the prosecution of the Public Prosecutor's Office of Paraná, contradicted Federal Law 8,672 / 1993.
This understanding of the MP was upheld by Judge Tiago Gagliano Pinto Alberto, of the 2nd Court of Public Finance of Curitiba, who in March 2017 condemned the former secretary of Lerner to suspend political rights for three years, prohibited him from contracting with the Power Public or receive benefits or incentives and also determined the payment of a fine.
Almost a year later, the judge Carlos Mansur Arida, accompanied by the other magistrates of the Fifth Civil Chamber of the TJ, reformed this decision. For the judges, Campelo Filho can not be condemned because at the time of the events, in 2002, there was "a great deal of legislative, jurisprudential and doctrinal confusion related to the subject.” For the magistrates there was no deceit from the former secretary when lowering the resolution authorizing the operation of the bingos in Paraná.
"This time, after all the above-mentioned historical-legislative deepening, I understand that the act of issuing the resolution can not be configured as fraudulent, given the existence, at the time, of a great smoke of good law related to the subject and existence of a state rule authorizing," says an excerpt from the decision.
As for the suspicion that Campelo Filho had used "figureheads" to acquire two bingo companies in Curitiba at the time: Bingo Mirage and Bingo Millenium, the Court also cleared him. "It appears that there is no record in the case file of the appellant's claim that the appellant (Campelo Filho) acquired shares of the bingo houses through ‘figureheads’, in order to enrich illicitly. Any conviction related to the perceived economic advantage and/or illicit enrichment depending on the position is also prejudiced," says the sentence.
Speaking about bingos, this year Senator Ciro Nogueira tried via a new bill to authorize the exploration of bingos, jogo do bicho, videogame and other betting modalities - like casinos- in the country. The proposal came to be approved in the Special Commission of National Development (CEDN), but ended up blocked by the Commission of Constitution, Justice and Citizenship (CCJ) of the Senate.
Despite the contrary opinion of the CCJ, the proposal goes to a vote in the plenary of the Federal Senate, but only enters the voting list when President Rodrigo Maia (DEM) considers it is the appropriate time.
