City Council President seeks to create Foz do Iguaçu Municipal Lottery

The president of the City Council, Ney Patrício (PSD), proposed the creation of a Municipal Lottery in Foz do Iguaçu, city of the state of Paraná in the south of Brazil where the famous Iguazu Falls are located on the border with Argentina. Application No. 672/2021, authored by the councilor, suggesting the holding of a public hearing to debate the issue, was approved at the session last Thursday (14). According to the congressman, in addition to contributing to the collection of taxes, the plan aims to boost economic recovery in Foz.

Revenues from betting or ticket sales will be earmarked exclusively for essential sectors such as health, sports, social assistance, culture, public safety, human rights and social security.

The values ​​of prizes not claimed by eligible players, within the limitation period provided for in the regulation, will be reverted to the Municipal Social Assistance Fund, among other portfolios, directly benefiting public policies of great collective impact.

In September 2020, the Federal Supreme Court (STF) unanimously decided that the Union does not have a monopoly to maintain lottery games, which can be created and operated by states and municipalities as well, as long as they comply with federal regulations. With the release of regulations, the subject gained prominence in the states, with the presentation of projects for the creation of local lotteries.

“This proposal is in addition to our actions to move the local economy, bringing a new source of resources for investments in various social areas. Our idea is to listen to the population and also the Executive about the creation. Since we have a proposal for a State Lottery in progress in the Legislative Assembly,” argued Ney Patrício.

In justifying the request, Patrício mentioned the “Lotepar” project that creates the Paraná Lottery, sent by Governor Ratinho Junior to the Legislative Assembly. According to him, this is an alternative measure for the recovery of the local economy, among others in force. “The STF understood that states and municipalities can explore this type of service provision, but making it clear that the destination of fundraising needs to have specific objectives,” he said.

The exploitation of games, according to Federal Law No. 13,756/2018, by states and municipalities was approved by the Supreme Court (STF) in September 2020.

In this way, Ney Patrício stated that "the total collection obtained through the capture of bets or the sale of tickets, by physical or virtual means, should be destined to the municipal social security, to the financing of actions and projects for the contribution of resources in the areas social assistance, human rights, sports, culture, health and public safety. The payment of prizes is also paid with the payment of income tax on the prize and the coverage of expenses related to the cost and maintenance of the operation of the municipal lottery.”
