The text replacing Bill 442/91 was prepared by Federal Deputy Felipe Carreras (PSB-PE) within the scope of the Working Group (WG) created by Arthur Lira in September and proposes the legalization of all types of games, such as integrated casinos in resorts, urban casinos, sports betting, bingo and horse racing.
With urgent approval, the Bill naturally enters the Agenda and can be voted on immediately. According to the regulations of the Chamber, depending on the approval of the urgent requirement, the project will not need to go through the House committees. In this regard, the original project had been approved by a special commission created for this purpose.
The coordinator of the WG, deputy Bacelar (Podemos/BA), had already stated several times over the past few days that the intention was to vote on the Regulatory Framework for Gaming this year and the support of President Arthur Lira was essential for approval from the project.
According to him, the work carried out in such a short space was a victory for the WG and crowning success. "We have already met with all government agencies that take care of inspection, regularization and other federal entities. The revision of Bill 442/91 of the WG was very well conducted by the Group and had an excellent report," commented Bacelar, saying that as of now the project can be voted on at any time.
The substitute proposes the creation of Sinaj – National Gaming System, comprising a federal regulatory and supervisory body, operating entities, betting agents, turf entities and accounting and operational authorship companies.
According to Bacelar, all topics were extensively discussed before preparing the final text, in order to address the concerns of opponents regarding money laundering and the risks of association with criminal activities and in order to protect the player.
On responsible gaming, the document proposes the creation of a “National Policy for the Protection of Players and Bettors” as well as the implementation of the National Register of Players and Bettors and criteria for the prevention of money laundering.
Among these criteria, it was defined that no operation can be carried out in physical money, in order to track all the financial transactions of the operator and also the player.
The proposal establishes a gaming and betting inspection fee (Tafija), with values defined according to the modality to be explored, which must be paid quarterly, as well as the application of the income tax on the GGR, as well as the 20% tax on the bettor prize.
The document also institutes the Cide-Games Contribution for Intervention in the Economic Domain, 25% on games sold online and 20% on sales in physical establishments, whose amounts will be divided between the Union, States and Municipalities.
In Plenary, the text can be amended in the form of amendments and then forwarded to the Senate. The opposition to the project linked to the armaments bench wants to remove the chapter dealing with bingos, alleging inspection difficulties and problems arising from a past when bingos operated in Brazil without the technology that exists today for tracking resources and the correct and fair way of operating the modality.
