Felipe Carreras delivers final report that proposes legalization of all gaming verticals in Brazil

Federal Deputy Felipe Carreras (PSB-PE) delivered yesterday (15) to the Federal Chamber the final report prepared in the Working Group (WG) of the Regulatory Framework that proposes the legalization of all gaming verticals in Brazil. The 69-page document foresees the operation of casinos in integrated leisure complexes, tourist (or urban) casinos, bingos, machine rooms, online games, jogo do bicho, horse racing betting and skill games.

Since September the WG of the Regulatory Framework for Gaming, created by the Mayor, Arthur Lira (PP-AL), has been working on the text and during this period its members met with various authorities, including Coaf, Federal Police, Ministry Federal Public and Internal Revenue, among others, to collect more information to support the preparation of the final report.

As already published in GMB, Cide-Jogos is created, whose revenue will be divided between the Union, States and Municipalities, as well as the National System of Games and Betting - Sinaj, consisting of:

I – by the federal regulator and supervisor of games and betting;

II – by the gaming and betting operators;

III – by tourism entities;

IV – by the accounting auditing companies and by the gaming and betting operations auditing companies registered with the federal regulatory and supervisory body;

V - by the self-regulatory entities of the gaming and betting Market registered with the federal regulatory and supervisory agency; and

VI – by the machine operating companies.

Under the proposal, a gaming and betting inspection fee (Tafija) is established, with values defined according to the modality to be operated by the operator, as well as the application of income tax on the GGR, as well as tax on the prize to the bettor of 20%.

In the substitute, it is pointed out that "illegal gaming in Brazil move more than BRL 27 billion per year, surpassing by almost 60% the official ones, which generate BRL 17.1 billion," which in itself gives the necessary merit to the discussion and approval of a legal framework for the gaming.

The document also deals with player protection, by creating a "National Policy for the Protection of Players and Bettors" as well as the implementation of the National Register of Players and Bettors and criteria for the prevention of money laundering.

In his most recent replacement, rapporteur Felipe Carreras reinforced the rules to identify and prohibit compulsive gamblers' access. By the text, all players will be registered in a system called Renapro (National Register of Prohibited). The registration will have the player's name, CPF, date of birth and their respective address.

In addition, it is determined that relatives of ludopaths will be able to register their relatives in Renapro to prevent compulsive gamblers from having access to any type of game. This item was included to mitigate the resistance of the evangelical bench in the Chamber, which has intensified lobbying against the text.

Arthur Lira intends to vote on the urgency today (16), to start the discussion of the proposal in Plenary so that the merits can be considered at the beginning of next year.

"There is no agreement, but there is a lot of conversation," said Lira on Wednesday (15). On Monday (13), the president of the Chamber tried to put the project to a vote, but there was resistance from evangelicals. "The thesis does not have a closed position, in support or against, but it is agreed with the leaders to discuss and work on this issue," stated Lira. "There is the possibility, proposed by the opposition, which is to open the discussion, adjust the text, close the discussion and vote next year," he concluded.
