Lawyer Sigrid Barros Martins (OAB / AM 14696) forwarded the civil association's request to Minister Luis Fux, of the Supreme Federal Court, where he requires qualification as an “amicus curiae” due to the nature and objectives of RE 966177.
The Bingos Association (ASBIN), constituted on April 25, 2019, is a non-profit entity that, according to its statute which is registered according to register 5314 of book A, has the purpose of researching and stimulating studies and research on games, lotteries, prediction contests, sweepstakes, and entertainment, as well as promoting the legalization and creation of a regulatory framework for these activities in collaboration with the competent public authorities. The businessman from the municipality of Porto Velho - Rondônia, Erivelton Athanasio Araújo Ximenes, is its president.
The entity also collaborates for training aimed at the formation of human resources in games, lotteries, prediction contests, sweepstakes and entertainment, promoting the qualification and updating of these participants, throughout the national territory, promoting and disseminating the legalization of games, lotteries, predictions, sweepstakes and entertainment contests in the country, through exchanges with other similar entities in Brazil and abroad.
Among other research and development activities to be carried out and supported by the Entity include:
a) The theoretical work carried out in a systematic way for the acquisition of new knowledge, in order to reach a broad and precise understanding of the researched fundamentals and their application in practice;
b) The results obtained with the research will be applied to the new facts, or devices, allowing the implementation of new processes, systems and services, as well as improvement and the introduction of new techniques;
c) Training aimed at training human resources in games, lotteries, prediction contests, sweepstakes and entertainment;
d) Training and qualification of professionals in human resources programs, with the participation of specialists from Brazil and abroad;
e) To seek the fixation, expansion and reproduction of theoretical development knowledge through the effective integration of teaching and research entities in development projects;
f) Promote and support events, courses and seminars that contribute to the technical and theoretical development of staff;
g) Seek continued training in project management and development activities;
h) Promote and disseminate the legalization of games, lotteries, prediction contests, sweepstakes and entertainment in the country, through exchanges with other similar entities in Brazil and abroad;
i) Contribute to the promotion and development of cooperative projects, optimizing material and human resources available in the respective institutions and private companies, and may even enter into agreements with similar entities;
j) Inform, clarify and train the participating members of the entity, on the discussions and matters absorbed, promoting training when necessary;
k) Promote culture, defense and conservation of historical and artistic heritage linked to games, lotteries, prediction contests, sweepstakes and entertainment; and promoting ethics, peace, citizenship, human rights, democracy and other universal values.
The civil association was based in the city of Rio Branco - State of Acre, but last January the General Assembly changed the address and moved to Rua Júlio Conceição, 92 - Bairro Bom Retiro, Conjunto Comercial nº 32 on the 3rd Floor of the Prince building Tower, São Paulo - SP, CEP: 01126-000.
At the end of 2020, Minister Luiz Fux, president of the Supreme Federal Court, released the trial schedule for the 37 plenary sessions scheduled for the first half of 2021. The agenda gave priority to those dealing with the realization of civil and economic freedoms. On April 7, RE 966.177 will be dealt with, which addresses the typical conduct of establishing and exploring games of chance. This ruling may be key to the decriminalization of activity in Brazil.
In the current legal situation, the exploitation of gambling is considered a criminal offense, and the criminal proceedings in progress may be suspended due to the application of the rule of article 1.035, paragraph 5, of the Civil Procedure Code, occasion is where when the statute of limitations will also be suspended, except for arrested defendants. While the Supreme Court does not decide the matter definitively, the current legal situation in which the exploitation of gambling is considered a criminal offense remains in force.
