More than US$180m per month from lottery collection could aid the pandemic in Brazil

Deputy AJ Albuquerque (PP / CE) presented Bill 891/2021 which establishes a regime for the extraordinary allocation of the proceeds from the total collection obtained by federal lotteries to defray expenses with residual emergency aid established to face the social and economic consequences of the pandemic. According to him, an average monthly amount of more than US$180m would be able to help more than 1.5 million Brazilians with an emergency aid of R$ 300 (US$55).

In the deputy's project, the National Congress decrees:

Art. 1 During the validity of a legislative proposal to establish residual emergency aid to face the social and economic consequences of the COVID-19 pandemic, the proceeds of the bets made in the federal lottery modalities specified in art. 14, Paragraph 1 of Law No. 13,756, of December 12, 2018 will respect the extraordinary destination regime specified in this Law:

I - The proceeds from the collection of the federal lottery will be allocated as follows:

a) 17.04% for social security;
b) 17.39% to cover the cost of expenses and maintenance of the operating agent of the federal lottery;
c) 60% for the payment of prizes and the payment of income tax on the prize; and
d) 5.57% to the single National Treasury account for the exclusive use in defraying the expenses with residual emergency aid established by legislative proposal to face the social and economic consequences of the pandemic of the COVID-19.

II- The proceeds from the collection of the federal numerical prediction lottery will be destined as follows:

a) 17.32% for social security;
b) 19.13% to cover the cost of expenses and maintenance of the operating agent of the lottery of numerical predictions;
c) 43.55% for the payment of prizes and the payment of income tax on the prize; and
d) 20% (twenty whole percent) for the single National Treasury account for the exclusive use in defraying the expenses with residual emergency aid established by legislative proposal to face the social and economic consequences of the COVID-19 pandemic.

III- The proceeds from the collection of the specific prognosis lottery will be allocated as follows:
a) 1% for social security;
b) 20% to cover the cost and maintenance expenses of the agent operating the specific prognosis lottery;
c) 50% for the payment of prizes and the payment of income tax on the prize; and
d) 19% for the single National Treasury account for the exclusive use in defraying the expenses with residual emergency aid established by legislative proposal to face the social and economic consequences of the COVID-19 pandemic.

IV- The proceeds from the collection of the sports forecasting lottery will be allocated as follows:

a) 7.61% for social security;
b) 19.13% to cover the cost of expenses and maintenance of the agent operating the sports forecast lottery;
c) 55% for the payment of prizes and the payment of income tax on the prize; and
d) 18.26% to the single National Treasury account for the exclusive use in defraying the expenses with residual emergency aid established by legislative proposal to face the social and economic consequences of the pandemic of the COVID-19.

V- The proceeds from the collection of each issue of Lotex will be destined as follows:
a) 0.40 for social security;
b) 18.30% to cover the cost of expenses and maintenance of the operating agent of Lotex;
c) 65% for the payment of prizes and the payment of income tax on the prize; and
d) 16.30% for the single National Treasury account for the exclusive use in defraying the expenses with residual emergency aid established by legislative proposal to face the social and economic consequences of the COVID-19 pandemic.

§1º - The operating agents shall deposit in the single account of the National Treasury the amounts destined for social security, income tax levied on the prizes and the cost of the expenses with residual emergency aid established by legislative proposal to face the social and economic consequences of the pandemic of the COVID-19.

§2º The values of the prizes related to the lottery modalities referred to in items I to IV of this article, not claimed by the bettors contemplated in the statutory period ended during the term of the emergency assistance referred to in this law, will be reverted to the cost of the same.

In his justification, the deputy argues the following:

Considering the profound social and economic effects resulting from the COVID-19 pandemic that has been plaguing Brazil and the world for a year, considering the imminent need to resume emergency aid to support those who are in a situation of social vulnerability due to the extended context of crisis, and, considering, still, the deep budget deficit that Brazil has been experiencing as a result of the huge public expenditures necessary to fight the pandemic in all the extraordinary destination of the proceeds of the total collection obtained by capturing the bets made in the federal lotteries, as a way to help defray the expenses of a residual emergency aid to be created in exclusive legislation for this purpose, during the concession period, as a way to mitigate the social and economic consequences of the COVID -19 pandemic.

The extraordinary allocation regime proposed here allocates, based on 2019 data collected on the Caixa Econômica Federal website, an average monthly amount of more than half a billion reais, which can help more than 1.5 million Brazilians per month with an emergency aid of R$ 300. The moment is one of crisis and all efforts and creative arrangements must be made as a way to alleviate the difficulties and pain of our Brazilian brothers during this very difficult page in our history, where more than 260,000 lives have already been lost at a rate of increasing unemployment and informality in Brazil.
