Deputy Neném Almeida proposes bill to create lottery in Brazil’s state of Acre

State deputy Neném Almeida (without a party) filed on Wednesday (28) a bill in the Legislative Assembly of Acre (Aleac) that institutes the public lottery service, under the name ‘Loteria do Acre – LOTAC’, based on the judgment of Brazil’s Supreme Court that understood that it did not privilege to the federal government regarding the establishment and operation of lotteries.

According to the Bill LOTAC will be conducted directly by a public agency or competent public entity in the State of Acre or, alternatively, by a private company constituted in the form of a legal entity under private law, under the condition of concession, permission or accredited organization.

The text proposes that it can only be accredited for the exploitation of lottery modalities of the Loteria do Acre - LOTAC legal entity regularly constituted according to the Brazilian laws in force, with headquarters and administration in the country, which, in order to obtain the accreditation, present required documentation about the respective legal qualification, tax and labor regularity, and economic qualification.

In addition, companies should consider certifications regarding the adoption of practices dedicated to the promotion of responsible gambling and the protection of vulnerable people, as well as the certification of the health and smoothness of computer programs and equipment to be used in the operation of lottery modalities.

According to the author of the proposal, the bill seeks to establish a public service to be provided to the population of the State, based on the jurisprudential understanding signed by the Federal Supreme Court in the judgment of the Fundamental Precept Failure Arguments.

Such regulation observes the need for the Government to act in inhibiting the expansion of the informal economy, ensuring an environment favorable to the economic and social development of the State, since the creation and exploitation of the State Lottery of the Government of the State of Acre may come to proves to be a considerable source of funds for the financing of public policies under the responsibility of the Executive Branch of the State of Acre, particularly in this period of public health emergency caused by the COVID-19 pandemic, the biggest health crisis of the last century,” stated Almeida.

Neném pointed out that another relevant aspect of the proposal is the allocation of resources to city halls through the transfer of part of the revenue both in the case of passive lottery modalities of previously numbered tickets, or numerical and instant predictions; as for fixed odds betting; which will benefit municipalities that are facing serious difficulties for investments in health.

This regulation in practical terms will have a double effect on our domestic economy, as it will create an environment favorable to the economic development of the State with the generation of jobs, as well as a considerable source of resources for the winners of the prizes and, especially, the State. With resources for investments in important portfolios such as health and for Municipalities that lack financial contribution initiatives,” he concluded.
