The bill sent by São Paulo governor João Dória proposes the creation of the São Paulo lottery and provides for the repeal of article 15 of Laws nº 5.256/86, nº 9.761/97, 10.242/99 and nº 10.871/01, which deal with the former lottery that was operated in the State of São Paulo.
For deputy Alex de Madureira, there was no clarity in the proposal about the creation of the lottery and the destination of the funds raised. For him, “this must be clear in the Bill”. In his report, the deputy extrapolates by saying that other states must also have old laws dealing with state lotteries. He goes so far as to say that “it is likely that almost all states have old laws dealing with state lottery. The decree of Piauí, for example, uses State Law nº 1.192 / 1955 as a basis for regulation,” he says.
In his replacement, Madureira excludes article 14 of the project approved by the São Paulo Legislative Assembly committees, which authorizes the creation of the São Paulo Lottery, maintaining article 17, which revoked the old state legislation on lotteries.
The deputy points out in his decision that it would not be up to the state government to present a project to institute the operation of a lottery to finance social assistance in the same proposal in which loans are requested for other activities to be carried out in the scope of São Paulo. As in the initial proposal, the bill provides that the lottery will fund the “Bolsa do `Povo” aid program, the deputy states that “this needs to be made clear in the bill now presented by the Executive.”
Bill 359/21 has already been approved by the Legislative Assembly's Justice and Finance and Budget committees. With the report contrary to the approval of the project as it was prepared, it is expected that the Executive will send a new proposal to Alesp or that the plenary will discuss possible amendments or alterations to the initial project so that the São Paulo Lottery is approved and later sanctioned by Governor João Dória.
