Governor Joao Doria sanctions law to institute the São Paulo State Lottery

The project to create a new lottery in the state of São Paulo is already a reality. The proposal, authored by Governor João Dória, now has the approval of the Executive. According to Art. 15 of Law No. 17,386, all the money raised with the new lottery will be used for 'funding actions aimed at social assistance and reducing social vulnerability' in São Paulo. The government of the state has already launched a call for the presentation of studies for the implementation and operation of lotteries in the state.

A month ago, the Executive Bill 359/21 was approved, which authorizes the state government to make loans to finance works, mobility, housing and health, totaling R$ 5 billion, and also to create the Lottery of the State of São Paulo. The proposal, authored by Governor João Dória, now has the approval of the Executive. The project was approved by 53 votes in favor and 20 against.

Finally, this morning (15) the executive branch published the sanction of the law with the following text:

Art. 15 – The Executive Branch is authorized to establish and exploit, following to article 175 of the Constitution of the Republic, the São Paulo State Lottery, and shall use the net result obtained to fund actions aimed at social assistance and the reduction of vulnerability in the State of São Paulo.

Last week, the government of São Paulo published the Public Call Notice 004/2021, in which it invites interested parties to present studies for the implementation and operation of lotteries in the State, with the objective of "provision of lottery services contemplating the creation of products in the modalities with the greatest potential for exploitation, such as numerical prognostics, instant lotteries and fixed-rate betting,” as published by the state administration.

The project foresees the implementation and operation of lotteries in the State of São Paulo, considering the STF decision. The project was included in the State Partnership Program on June 29 by the Working Group (WG) established to conduct all the work necessary to formulate the final model of the project.

The purpose of the call is to obtain feasibility studies, surveys, investigations, data, technical information, projects or opinions for the implementation and operation of lottery services in the State of São Paulo, covering possible models for delegation to the private sector.

The end of the Union's monopoly in the exploitation of lotteries, decided last year by the Federal Supreme Court, guaranteed that the presentation of a project for the creation of the São Paulo State Lottery would not conflict with federal legislation.

Interested parties must request authorization by July 19 and the WG will have 15 days to analyze the requests. After authorization, interested parties will be called by the Working Group to present the premises adopted for the preparation of the study.
