Brazilian Senator proposes allocation of 1% of lotteries to support COVID orphan children

Senator Eliziane Gama presented Bill 2180/21 establishing the Facovid (Support Fund for Orphaned Children by COVID-19), which provides that part of the resources allocated to it will come from lotteries. 'It is projected that resources in the order of R$ 150 million (US$29.7m) per year will be available to meet this need... the portion allocated to the cost and maintenance of the agent operating the lottery will be reduced,', according to her justification for the project.

Bill 2180/21, by Senator Eliziane Gama, intends to “establish the Fund for the Support of Orphaned Children by Covid-19 (FACOVID) and amends Law No. 13.756, of December 12, 2018, to include it among the recipients of the product of the collection of the lottery of numerical predictions,” proposes the senator.

The institution of the new fund intends that 1% of the amount collected from the lotteries be destined to assist children orphaned for the loss of "fathers and mothers, grandfathers and grandmothers, stepfathers and stepmothers, uncles and aunts, spouses, partners or companions, brothers and sisters or adult stepchildren, who live under the same roof as the orphans, as well as the relationships arising from guardianship and guardianship.”

For the constitution of resources to FACOVID, Eliziane Gama defines, in item IV of art. 2:

"IV - those relating to participation in the proceeds of the collection of the numerical predictions lottery pursuant to subparagraph j of item II of the main section of art. 16 of Law No. 13.756, of December 12, 2018.”

In her justification, the senator states that: “It is important to say that, in order to finance this initiative, 1% of the proceeds from the collection of the numerical predictions lottery will be allocated, in addition to other sources listed in the project. This time, it is projected that resources in the order of R$ 150 million (US$29.7m) per year will be available to meet this need. At the same time, the portion allocated to the cost and maintenance of the lottery operator's agent will be reduced. In other words, Caixa Econômica Federal will have a percentage of 18.13%, without this reduction in any way compromising the administration of lotteries. Additionally, the measure will have no fiscal impact, as it will not have existing budget revenues, thus respecting the Fiscal Responsibility Law (LRF) regarding the expansion of public expenditure.”

The bill is in progress in the Senate and after analysis in the House, it will be sent to the Chamber of Deputies for review and, in case of approval, addressed to the Presidency of the Republic, for sanction.
