Committee to vote Bill that bans use of cards and electronic currency on betting sites abroad

While the Ministry of Economy is advancing on its side with the final regulation of the sports betting market in Brazil, the Economic Affairs Committee (CAE) will vote on Tuesday (28) on the project of senator Ciro Nogueira (PP-PI) which prohibits transactions with credit or debit cards, and also electronic currency, which are intended to bet on games of chance on sites hosted outside the country (Bill 213/2017).

According to the bill, it will be up to the Central Bank to establish control rules prohibiting companies to authorize payments for this purpose, as well as any transfer of amounts between bettors and suppliers.

In justifying the project, citing press data, Ciro Nogueira estimated that around R$ 3 billion (US$ 566m) per year are being spent by Brazilians on online gaming.

The report by senator Jorginho Mello (PL-SC) recommends the approval of the project, confirming the understanding that Brazilian legislation is silent on the prohibition of Brazilian bets on websites abroad.

A quick internet search allows us to verify the large number of sites, most of them in Portuguese, that offer bets of this type, including for Brazilian championship games. Meanwhile, the collection of lotteries administered by Caixa Econômica Federal experienced, in 2016, a drop of the order of 14% in relation to 2015,” said the rapporteur.

Mello offered an amendment extending the legal ban on the purchase of credits for gameplay in simulated environments, in order to avoid maneuvers that make it impossible to track operations.

The decision of the CAE is final: if the project is approved and there is no appeal for voting in the Plenary, the text will be analyzed by the Chamber of Deputies.
