The idea, as found out by JOTA, is that only contests and sweepstakes with values from R$ 10 thousand (US$ 1,615) are required to register with Secap, collecting the fees due. Today, these trade promotions have to be authorized by the government, regardless of the prize amount. Thus, the intention is only to have requirements for events with really significant prizes.
“The simplification of processes for commercial promotions, such as the removal of the authorization requirement for small-scale processes, are in line with a State that trusts the private sector and its ability to generate new business, employment and income. The improvements will also reduce warnings and sanctions, preventing the opening of administrative processes when there are small flaws and there is good faith on the part of the promoter of the action,” Guimarães told JOTA.
He recalled that in an increasingly agile and digital world. “These changes are in line with the new social dynamics, especially the commercial promotions that today also take place on the social networks of companies and institutions, in addition to stimulating the economic activity of small entrepreneurs,” he added.
Sought after, the substitute secretary of Secap, Fernando Sertã, did not give an interview and the ministry's advicers limited itself to confirming that the topic “is still being debated internally.”
To change the rules for trade promotion, a new law is needed. There is the possibility of a Provisional Measure on the subject. To update the fees that will be charged in operations above R$ 10,000, (US$ 1,615) a decree is enough.
One source says that rates haven't changed for 20 years, despite the law requiring them to do so. It is charged by award tier. The idea that was on the table was to replace half of the inflation of that period, which would double the values, but until a final decision this can be changed.
