If approved, the measure will allow the Executive to open bidding processes to grant authorization to private institutions.
The project is being analyzed by the Constitution, Justice and Writing Committee (CCJR), the House Attorney's Office and Technical Committees on merit. If approved, it is forwarded for a vote in the Plenary.
"Even as a public service, especially those related to the commercialization, distribution or dissemination of lottery products, they admit the delegation to the private sector through concession, permission or authorization," said the governor in the text.
Since 2020, the Federal Supreme Court (STF) has authorized states and the Federal District, as well as the Union, to explore lottery games. In the text sent by the governor, the State will admit the accreditation of interested parties by public call. Previously, state lotteries had a fixed ticket limit, and new lottery modalities could not be created.
The money collected by the Lottery of the State of Ceará (Lotece) must be destined to the service of the "public interest" of the State, following the federal legislation. However, it is not specified where the resource will be invested. The Federal Constitution requires that the net income collected from lottery games be applied to social and medical care measures.

The measure modified the decree-law and only allowed the continuity of existing state lotteries, and with a fixed ticket limit, prohibiting the creation of new local lottery modalities, which is why, until the voting date, only 12 states were considered allowed to explore the activities.
“The Constitution does not grant the Union this exclusivity and did not expressly or implicitly prohibit the operation of state lotteries,” said Minister Gilmar Mendes, at the time of the vote on the permission.
