The project, presented by the Chief Executive on October 31, establishes at 2% the Tax on Services of Any Nature (ISS) rate for companies in the lottery sector, bingos, cards, bets, sweepstakes, prizes and capitalization bonds. The proposal was one of the highlights of the SBC Summit Latinoamerica, an event held in October in Miami and one of the most important in the world in the sector.
Fabio Riva (PSDB), councilman and leader of the government in the Chamber, stressed the importance of the capital of São Paulo having a competitive ISS rate and that can attract large international companies in the sector.
"It is public and notorious a fiscal war with the issue of ISS of several companies, especially new companies of technology and digital games," said the parliamentarian in defending the approval of the proposal. "These companies, by settling here, generate jobs and income. So it's a win-win game."
The proposal of Bill 613/2022 was born in late September 2022, when Mayor Ricardo Nunes received in audience representatives of Entain, one of the largest companies in the world in the area of sports betting.
The meeting, requested by the lawyer specializing in gaming legislation Luiz Felipe Maia, had the support of Councilman Fábio Riva, and demonstrated the strong interest of international bookmakers to settle in Brazil.
In the current scenario, many players in the sector have been preparing to start their local operations, pending the regulation of Federal Law No. 13,756/18, which authorized the fixed-quota lotteries market.
The meeting took place at a time when the municipal executive has the plan to encourage investments in the sector and transform São Paulo into the largest Brazilian hub of betting and fantasy games companies.
In the text of the project, Nunes explains that "the proposed framework for the rates of the Tax on Services of Any Nature (ISS) in relation to the segmented has as its primary purpose the retention and attraction of companies whose establishments have high mobility."
