The government of São Paulo resumed the project of granting the state lottery to the private sector with the publication in the Official Gazette of the International Competition Notice SOG 02/2022, which will have a term of 20 years and an estimated value of R$ 935,458,198.59 (US$ 182m).
The international bidding will grant the private sector the operation of the fixed quota betting lottery modalities (sports betting), specific prognosis lottery, sports prognosis lottery, numerical prognostic lottery, instant lottery and passive lottery.
The Notice provides for the delivery of envelopes with the necessary documentation for the participation of the bidding on 01/12, from 16 to 16h15, in Public Session at B3 - São Paulo Stock Exchange. Until November 16, interested parties will be able to submit a request for clarification and information about the bidding for the email [email protected], whose replies will be transmitted to all interested parties on the www.saopaulo.sp.gov.br/loterias site until November 24.
Legal and technical qualification documents must demonstrate the bidder's qualification to perform the activity provided for in the international bidding, as well as safety and responsible gaming certifications of WLA, ISO 27.001, GLI-14, GLI-19, GLI-23 and GLI-33, in addition to RNG certificate issued by an international certifying body.
The Budget and Management Secretariat has defined the minimum payouts for the modalities currently tendered, i.e.:
· 45% for the numerical prognosis lottery;
· 50% for the specific prognostic lottery;
· 55% for the sports prognosis lottery;
· 65% for instant lottery;
· 60% for passive lottery; and
· 70% for the fixed quota lottery.
The required game plans and minimum payouts must be defined by the concession companies.
For the preparation of the price proposal and for the eventual formulation of bids, bidders should consider that, by delegation of the public service subject to the concession, the concessionaire shall pay the granting power the amount offered as a fixed grant. This will be the criterion of judgment of the bid and will be taken into account the highest amount as a fixed grant due, to be paid by the contractor as a condition for the signing of the contract, considering as a minimum fixed grant the amount of R$ 906,303,455 (US$ 176m), on the base date of September 2022.
The bidding will be processed and judged with a reversal of the phases, initially analyzing the price proposal, classifying the price proposals, processing, if applicable, the out-of-the-box bidding phase, and then analyzing the bid guarantee and qualification documents, both from the bidder who has offered the best price proposal, under the terms of the Notice.
The bidding will be processed and judged by CEL, with operational support from B3 to assist in conducting the bidding process and carrying out related activities, in compliance with the clauses provided for in the Public Notice.
