The president of Brazil has had the document in his hands since mid-July, but decided to turn a blind eye until he missed the deadline to sign the decree and an interim measure that provides for the regularization of this market last Monday (12).
By omission, Bolsonaro may respond for a crime of responsibility against probity in the administration, as provided for in Law 1.079, 1950.
The ninth article of Chapter V of this law provides that they are crimes of responsibility "to omit or intentionally delay the publication of the laws and resolutions of the Legislative Branch or the acts of the Executive Branch."
As the project was approved in Congress and sanctioned by Michel Temer in 2018, the Ministry of Economy and the Civil House worked together to regulate the market in the last four years. Bolsonaro, by his own decision, decided to break the law and may be penalized alone for it.
