Consumer Defense Institute notifies Caixa Loterias for tie-in sale in app

The Amazonas agency of the Brazilian Consumer Protection Institute (Procon-AM) notified Caixa Lotteries this Monday (9) requesting the company to provide the entity with a response on tying sales records, conduct prohibited by the Consumer Protection Code. Procon-AM cites the requirement of R$ 30 as a minimum amount for purchases in the Loterias Caixa app, and the service has betting options starting at R$ 2.50.

The Consumer Protection Institute (Procon-AM) has notified Caixa Lotteries to manifest records of tied sales, conduct prohibited by the Consumer Protection Code (CDC). Procon-AM cites the requirement of R$ 30 as a minimum amount for purchases in the Loterias Caixa app, and the service has betting options starting at R$ 2.50. With this, the consumer is obliged to acquire a certain number in bets to make the purchase.

In the document, Procon-AM recommends that the company immediately readjust the offers available in the application, and that it submit clarifications to the agency within ten days.

“Typical selling is something that has been fought by Procon Amazonas, and, in this case, we identified that the Caixa application conditions a minimum value for its use, which is not allowed under the law. The objective of our action is to guarantee consumers the free exercise of their rights,” says the director-president of Procon-AM, Jalil Fraxe.
