Unanimously, in a total of 33 judges, the TJ-MA understood that the competitive regime with multiple operators is the one that best serves public interests, as it allows for greater capillarity of lottery services, in addition to enabling the exploitation of all permitted lottery modalities.
The Court considered that the accreditation notice issued by MAPA did not contain any clause restricting participation, since 4 (four) consortia were accredited. With this judgment, Lotema takes another step towards starting the operation of lottery games in the State of Maranhão.
In February, the process of implantation of the Lottery of Maranhão was suspended by order of the counselor Edmar Cutrim, of the State Court of Auditors, from the representation of Intralot do Brasil. According to the company, the public notice would have violated the precepts of the legislation applicable to concessions, “notably in relation to the content and profile of the bid object, in the case of public service, it would not involve being delegated through the use of the auxiliary procedure for the accreditation bidding.”
With the decision of the Court of Justice this Wednesday (25), Maranhão Partnerships will be able to continue with the Lotema implementation process through the consortia and company qualified in the accreditation notice: BRLotto Consortium (NGT Brasil, Skilrock Technologies Brasil and Everymatrix Brasil Tecnologia ), Lotema Consortium (Culloden Participações and VS N.V.), World Lottery Consortium (Prohards Commerce, Development and Services in Information Technology and JOTA EFE Entertainment) and SDL Lottery Distribution System.
