The productive meeting this Thursday (5), organized by the Sports, Lottery and Entertainment Games Law Commission OAB/RJ and the Games Law Commission OAB/DF, was led by the presidents of the entities, respectively Paulo Horn and Sérgio Garcia Alves, and had as its object the discussion of the draft of the presidential decree that regulates sports betting in Brazil. At the forefront of debates on the subject, the two entities highlighted the importance of prompt regulation of the activity in Brazil.
The meeting was reinforced by the presence of Daniel Homem de Carvalho, president of the National OAB Gaming Commission, which demonstrates the great involvement of the entity in serious discussions on the subject in the country.
In the introduction to the work, Sérgio Garcia Alves declared that the discussion would take into account ample legal documentation on the subject and the draft presidential decree released last Monday (2) by Games Magazine Brasil, citing this detail in the presentation itself.
After presenting what he called the route of time, from MP 846, of July/18, which dealt with the National Public Security Fund and destination of the lottery collection proceeds, through the approval of Law 13.768/2018, which created the lottery modality of sports betting as a public service.
He also highlighted other decrees and MPs dealing with the subject and the most recent law that changed the taxation of the fixed quota lottery (Law 14.183/2021). Finally, he presented the draft presidential decree made available by GMB.
Sérgio Garcia drew a comparison between the two preliminary versions of the sports betting regulation with the draft released this week, after which his colleague in charge of the Rio de Janeiro branch, Paulo Horn, commented on the importance of such an immediate discussion of the recently revealed document.
The most discussed points about presidential decree were tax issues, training, sports integrity, self-regulation and cost of authorizations. For the organizers, these are points very well defined by the team that prepared the draft.
Regarding the tax issue, there was a doubt as to the structure of the incidence of taxes. “Would the tax be due on a gaming portfolio? As the document talks about the sum of events, we need to understand this definition better,” was one of the questions by Sérgio Garcia Alves.
The requirement for an international and non-national body to monitor sports integrity was also addressed, as there was also a concern about the regulator's discretion in being able to limit the number of licenses in this first year.
The concern of some of the participants was regarding whether or not to maintain the current version, with a view to exchanging seats in the Ministry of Economy area and the appointment of a new person responsible for finalizing the regulatory process. “The OAB eagerly awaits the publication of the presidential decree,” was the message from the participants.
Those present also highlighted as very positive the points of the decree that deal with the operator's responsibility for responsible gambling and its involvement with the issue of the integrity of sports betting. At the same time, they supported the importance of mechanisms for the prevention of money laundering, as a preponderant factor for a reliable and transparent activity.
The participants were unanimous in asking Brazil to be quick in approving the regulation of sports betting to guarantee the generation of thousands of direct jobs in the country and the increase in tax collection for the good of society.
