New bill in Brazil's House proposes to prohibit internet transactions for access to betting

A bill that seeks to prohibit financial institutions from transactions through the internet for the purpose of participating in games of chance and unauthorized lotteries is currently pending in the Brazil’s Deputies Chamber. Under the proposal, the country’s Central Bank should establish rules to determine the cancellation of operations of this type and prohibit the transfer of amounts between buyers and suppliers.

Bill 1823/22 prohibits financial institutions that issue credit or debit cards, as well as any other payment institution, from authorizing transactions over the internet for the purpose of participating in unauthorized games of chance and lotteries or access to sites that present, sell, provide or disseminate images with pornography or sexually explicit scenes involving children or adolescents.

Under the proposal, that is being analysed by the Chamber of Deputies, the Central Bank of Brazil, in compliance with the guidelines established by the National Monetary Council, will establish rules to determine the immediate cancellation of transactions of this type and prohibit the transfer of amounts between buyers and suppliers.

Presented by Deputy Pastor Gil (PL-MA), the text includes the measure in Law 12,865/13, with the objective of limiting Internet users' access to illegal games and child pornography.

“We understand that it is essential to cancel any transaction in which illegal conduct is verified, thus preventing the transfer of values between the acquirer and the service provider,” he said.

“If the seller perceives that there is a risk of not receiving, he will be discouraged from accepting credit or debit cards or electronic currency as a means of payment,” he added.

According to the congressman, the idea is to encourage adult content sites not to offer products containing the participation of children under 18 years of age. “After all, under the proposed rules, this site would no longer be accredited by payment card companies, which would lead to a significant loss of its clientele,” he added.

The proposal will be analyzed conclusively by the Finance and Taxation committees; and Constitution and Justice and Citizenship.
