Espírito Santo approves complementary bill that regulates state lottery

The Legislative Assembly of Espírito Santo approved this Wednesday (12) the Complementary Bill 70/2023, which regulates the state lottery service. According to the text, the business model for operation would be a joint venture between Banestes and the private sector that would result in the creation of a third company (a subsidiary of Banco do Estado do Espírito Santo).

In accordance with PLC 70/2023, feasibility and convenience assessment studies carried out by Banco do Estado do Espírito Santo indicate the legal and financial viability of the proposed exploration model. According to the project, the state bank will be responsible for operating and operating the service.

One of the Executive's objectives is to obtain an increase in revenue. “The exploitation of the lottery service in Espírito Santo must optimize the potential for obtaining resources for the State, for the benefit of the social purposes of its collection, in accordance with the governing national legislation,” determines the PLC.

In May last year, another Executive Bill, approved urgently by the Assembly, gave rise to Law 11,617/22, which allows Banestes to establish subsidiaries and controlled companies, in addition to participation in companies.

According to the project, up to 12% of the total resources raised by the lottery will be allocated to the State, to be applied to programs in the areas of culture, sports, leisure, social assistance and tourism. The prize not collected by the winners must also have the same purpose.

Physical or virtual means may be used to capture bets, and the lottery modalities must be established by decree. Regulation, control and inspection will be the responsibility of the Public Services Regulatory Agency (Arsp).

The text also allows the opening of additional credits to make the future standard viable and revokes Law 11,236/2021 - which deals with the regulation of the Espírito Santo lottery - and article 2 of Law 1,928/1964.
