Lotex operation by Caixa and sports betting regulation force Privatization Program to be reviewed

Resolution 295/2023 was published this Tuesday (5), which recommends the exclusion of the instant lottery – Lotex and sports betting from the National Privatization Program. Furthermore, the document proposes to revoke the qualification of fixed-odd bets in the Investment Partnership Program. The measure was taken due to the future operation of Lotex by Caixa and the regulation of sports betting in Congress.

The Council of the Investment Partnership Program of the Presidency of the Republic published in this Tuesday's edition (5) of the Official Gazette of the Union Resolution 295/2023, which recommends, for approval by the President of the Republic, the exclusion of the public lottery service exclusive instant – Lotex and the public lottery service called fixed-quota betting of the National Privatization Program.

The Resolution also proposes the revocation of the qualification of sports betting in the Investment Partnership Program of the Presidency of the Republic.

The decision to exclude Lotex from the Privatization Program is due to the possible resumption of the ‘raspadinha’ (scratch card) operation by Caixa Econômica Federal, as already announced by the state bank three months ago.

At the end of August, the government relaunched Lotex by decree, which would initially be operated by Caixa, until a tender granted the modality to the private sector. According to the proposal, the ‘raspadinha’ would have physical and digital versions and the government pointed out in its studies, at the time, that it could raise around R$5 billion (US$ 1bn) with the instant lottery.

Regarding the exclusion of sports betting from the Privatization and Investment Partnership Programs, it is due to the imminent approval by the National Congress of the regulation of the activity through Bill 3626/2023, which defines unlimited grants to the private sector in the operation of fixed odds bets.
