Chamber Commission approves bill that prohibits influencers from promoting unregulated gambling

A bill that prohibits influencers from promoting unregulated gambling on social media in Brazil was approved by the Communications Committee of the Federal Chamber, and proposes to 'suspend' the work of digital influencers.

The text added four bills that wanted to prohibit the promotion of betting and hold influencers responsible for advertising content, but defined restrictions that were milder than the original ones.

The new proposal arrived this Thursday (7) to the House's Finance and Taxation Committee for consideration.

The text prohibits the promotion of unregulated gambling games on social media, such as casinos and the "jogo do tigrinho", which excludes sports betting (that is, even the promotion of bets without authorization to operate in the country would be free from restriction).

According to the project:

  • ?Influencers who promote irregular gambling may face a warning and a fine, in addition to "suspension from exercising digital influencer activity" for up to one year;
     
  • Social networks will be required to "cooperate with authorities in supervising and removing content published on their platforms" under penalty of warning and fine;
     
  • Advertising must inform about the negative consequences linked to betting, such as the risk of addiction and financial losses, and cannot be directed at minors;
     
  • Agencies must make available on their websites a list of all influencers hired to carry out publications on gambling.

What did the previous projects say?

The committee of deputies added four other projects to this bill:

  • Bill 3915/2023 which prohibited artists and digital influencers from advertising or promoting any type of gambling, including regulated ones;
     
  • Bill 4302/2023 which proposed to tax all revenue from digital betting advertising at 10%;
     
  • Bill 4933/2023, proposed by the CPI das Pirâmides Financeiras, which demanded transparency from agencies that hire influencers to publish digital assets, such as cryptocurrencies;
     
  • Bill 4394/2023, which transformed the dissemination of gambling into a criminal misdemeanor.
