Loteria do Maranhão takes the lead in Brazil and operation begins immediately

Maranhão takes the lead and runs ahead of the other 26 states and the DF, and should start its lottery operations in the next few days. The Court of Auditors overturned this Wednesday (19), the injunction that prevented the start of activities. This will allow the creation of a new source of revenue for use in public policies without increasing the tax burden, thus enabling large investments in essential areas, such as education and social security, as provided for in the Federal Constitution.

The seven counselors of the Court of Auditors of the State of Maranhão, decided this Wednesday (19), in plenary, unanimously, to overturn the caution issued by the recently retired and former councilor Edmar Cutrim, thus allowing the first state lottery in Brazil to begin operate, through its concessionaires, in a regulated manner following a decision by the Supreme Federal Court.

A little over a year ago, the STJ obstructed, in a preliminary manner, by questioning private companies, this constitutional right of the States guaranteed by the STF on September 30, 2020, when ADPFs 492, 493 and ADI 3050 were judged. Such questions came from companies in the market that did not agree with the model, or even because they had interests contrary to this exploration.

This meant that this public service could not move forward with the agility that was needed during that period. However, in an exemplary way and by decision on the merits, the Court of Auditors of the State of Maranhão correctly pacified this situation once and for all.

Jhonathas Mendes, Director of LOTEMA, told GMB: “This historic fact will benefit not only the State of Maranhão, but also all other states of the federation. This will unlock a large part of the private investment in this sector, which was repressed due to legal issues, but which, from now on, will generate jobs and income for the population and, most importantly, will be of great help to the social sector, which today so much suffers in Brazil.”
