Mayor of Pelotas in Rio Grande do Sul signs law that creates Lotopel

Mayor Paula Mascarenhas signed this Monday (24) Law 7.174/2023, which provides for the creation of the public lottery service in Pelotas called Lotopel. The norm authorizes the exploration, in the city, of any lottery modalities foreseen in the federal legislation. Part of the funds collected will be used to finance services in the health area, including transfers to philanthropic hospitals.

Pelotas is a Brazilian city and municipality, the fourth most populous in the southern state of Rio Grande do Sul.

According to Law 7.174/2023, the funds raised through betting and ticket sales for the Loteria de Pelotas will be used to pay prizes and pay income tax on the prize; the remuneration and cost of management and maintenance expenses of Lotopel's operating agent and for the free and unlinked financing of services, actions, projects and programs in the health area, including philanthropic hospitals.

Still according to the norm, the financing of health actions and services must observe the allocation of 60% to the Municipal Health Fund and 40% to philanthropic hospitals, with the resource divided equally between the institutions, for exclusive use within the scope of the SUS, through supervision and accountability to the Municipal Health Council.

The Executive should provide for the issuance of a Decree, in order to regulate the norm and define the rules, as well as the format for providing the service, whose exploration, possibly, should be subject to concession or permission to legal entities operating in the field, upon prior bidding process, in accordance with the rules for concession and permission of public services in effect.
