A survey by the Legislative Consultancy of the Legislative Assembly of the State of Pernambuco (ALEPE), presented at the meeting, showed parliamentarians the rules provided for in Federal Law No. 13,756/2018, which can be applied to this type of bet.
The norm authorizes, in its art. 29, the type of lottery called ‘fixed-odds betting’, in which it is possible to try to settle results in sporting events, as well as events throughout the match, such as expulsion of players or penalty kicks.
The text provides for the collection of income tax on the prizes, in addition to specific percentages for the National Public Security Fund, public education, and for the payment of image rights for clubs and athletes.
Legislative consultants Víctor Barreto and Rodrigo Accioly also spoke about what is expected from the Provisional Measure (PM) announced by the Federal Government on the subject. The amount to be paid by companies that intend to operate in the market was one of the highlighted points of concern, as Víctor Barreto explains: “A grant of R$ 20 to R$ 30 million (US$ 3.95 to US$ 5.95 million) is foreseen, a high value that can make many medium-sized companies that act today cannot be legalized.”
The consultant also noted that criminal practices that are closely linked to this type of economic activity, such as money laundering and tax evasion, need to be observed.
The period between the publication of the Provisional Measure and its conversion into law may be an opportunity to deepen the debate, in the opinion of the president of the Special Gambling Commission, deputy Joãozinho Tenório (Patriota).
“As there is already a 2018 law that awaits regulation by the federal government, our objective is that the collection does not remain with the Union alone, but that the cake is shared equally with states and municipalities. We also saw that this legislation already provides for transfers to public security. We want this amount to also be distributed to the Military Police and municipal guards,” he considered.
In the next meetings, the commission's parliamentarians intend to listen to sector businessmen, federal deputies and bodies such as the Pernambuco Regulatory Agency (ARPE) and the National Union of State Legislators and Legislators (UNALE).
