Brazilian Sports Betting Association launches petition for public consultation on regulation

The Brazilian Association of Sports Betting has just launched a petition for public consultation before the regulation of the sector. ABAESP understands that the draft of the Provisional Measure (PM) to be edited by the government must be presented to society so that everyone can offer contributions on the subject. The main concern of the entity is with the tax on the gambler/consumer.

The Brazilian Association of Sports Betting - ABAESP) concerned with the discussions surrounding the regulation of the sector, has just proposed a public consultation for the population to participate in the discussions and contribute to the improvement of the Provisional Measure about to be presented by the government.

In the open letter on the regulation of sports betting, ABAESP says “to express its concern with the escalation of the news” on the subject, which “has been frequently debated in several areas: governmental, institutional, political, business, sports, journalistic and consumerists. However, society lacks more accurate information,” stresses the entity.

“In particular, ABAESP is concerned about the tax on the gambler/consumer, which could create a double negative effect on the consumption pattern. This tax may discourage players from betting on licensed venues in Brazil, reduce job creation, encourage informality in the market and harm consumer safety.”

In addition, ABAESP is concerned about the added taxes on the GGR, “which have been shown to be around 31% in total - more than double the international good practice of 15%. This tax burden could have negative impacts on the economic sustainability of companies operating in the sector, as well as on the competitiveness of the market in general. It also brings a direct reflection on the quotations (odds) offered by the operator to the bettor, which, consequently, reduces the possibility of profitability of the consumer and his search for unlicensed offshore operators in Brazil.”

In the open letter, the Association says that “despite being requested, the federal government has not provided transparency on the official text of the Provisional Measure that it intends to send. It is extremely necessary to publish such a draft before issuing the Provisional Measure so that everyone can analyze it carefully and make the necessary contributions to a fair and competitive sports betting market.”

“ABAESP's understanding is that the draft Regulation should be offered to society, and that a Public Consultation be opened so that all those interested in a positively regulated activity can bring their contributions on the subject,” concludes the entity.

“With each passing day there is talk of changes in the PM and that it will be published today, tomorrow, this week or at the end of the month, but society needs to know its content, even if it goes through the legislative Houses. We believe that society should have access beforehand and that a public consultation be opened so that not only us, the consumers, but all those interested in a positive regulation for the market can give their opinion,” said Rodrigo Alves, president of ABAESP, to GMB.

For him, “the regulation will not achieve the objectives of bringing real benefits to any of those involved in the market.”

“We understand that a petition will provide conditions for the true participation of society in the discussions on the regulation of sports betting, so that it reaches what the government aims for, which is the generation of jobs and taxes, as well as for the gamblers have the adequate protection and the operators, conditions to compete and adequate form in the market,” he concluded.
