Court of Auditors councilor says there is no irregularity in Loteria Mineira bidding process

The counselor of the Court of Auditors (TCEMG) José Alves Viana, rapporteur of the processes related to the bidding procedure undertaken by the Minas Gerais State Lottery (LEMG), did not grant an injunction against the LEMG bidding process. Due to reports published in the press, he clarified that he did not do so “due to the lack of material evidence of irregularities.”

On the TCEMG website, counselor José Alves Viana made it public that “to date (5/8), there are five processes pending at TCEMG on LEMG International Public Bid 01/2023, four of which are complaints (processes 1141577, 1141594, 1141603 and 1144673) and a representation of state deputy Ricardo Campos (process 1144605).”

The clarification from the TCE informs that “after the first of these processes reached the Court, Counselor Viana's office soon analyzed the request for an injunction and decided not to grant it, due to the lack of materiality of irregularities.”

The five processes were joined (proceeding together) because they are related, and are under analysis by the Coordination for Inspection of Concessions and Privatizations. Such processes follow the rite established in the Organic Law of the TCEMG, including the deadlines established for the consideration of complaints, which have priority.

Counselor José Viana emphasizes that, “in the event that signs of irregularities are demonstrated, he will not shy away from taking the appropriate measures.”

In early April, the Mineira da Sorte consortium (IGT/Scientific Games/Saga BGI) was victorious in the bidding, with a 21% transfer to Loteria Mineira, to operate the traditional lotteries (instant and conventional) on an exclusive basis in Minas Gerais, including strategic planning services, product creation, printing solutions, storage, implementation and operation of lottery products, marketing, creation and operation of a distribution network, commercialization and payment of prizes.

The contract provides for a collection of R$ 5 billion (US$ 1b), with a minimum transfer of R$ 500 million (US$ 100m) to the State, over the 20-year term. Once all the legal stages of the process have been completed, the winning company will be able to implement a schedule of phases until starting the commercial exploitation of the games, which include the instant lottery (scratch card) and the conventional lottery (which uses the drawing of balls).
