The deputy's project establishes an amendment to Law 13756/2018 that legalized fixed-quota betting, so far not regulated by the federal government, preventing companies from setting up in Brazil.
According to the text, while the Ministry of Finance does not establish a way to regularize the activity of these sites, companies will be able to commercially exploit bets throughout the country. It is enough that they establish headquarters in Brazil and follow the Brazilian laws.
“We removed the need for an authorization or concession act by the Ministry of Finance, in view of the fact that it is exploration in a competitive environment, and for simplification purposes,” highlights the deputy in his justification for the project.
In early May, the Treasury presented the draft of what will be the provisional measure for sports betting. It contains indications of what the government will do with the sector, such as taxation on betting, operating rules for companies and the regulation of who can place bets, for example.
In his justification, Donizette points out that “sports betting houses have been growing sharply in Brazil, with estimates published in the press that the volume of bets in this modality is close to R$ 100 billion (US$ 20b) a year.”
According to him, if companies continue offering betting channels without establishing headquarters in the country, they will be framed in criminal misdemeanor – including those who place bets.
The deputy states that “in view of the inaction of the Executive Branch, we propose this Bill to provide that the exploitation of sports betting by residents of Brazil will only be allowed to legal entities constituted in accordance with the provisions of Brazilian law, under penalty of committing criminal misdemeanor.”
