Football player Eduardo Bauermann asks STF to not testify at sports betting CPI

Eduardo Bauermann, player from Santos Futebol Clube, called the Federal Supreme Court (STF) not to testify in the Parliamentary Commission of Inquiry (CPI) of sports betting, which currently takes place in the Chamber of Deputies. With the entry of an habeas corpus, the athlete seeks to be released from appearing in the Legislative House, since his summons was approved by the parliamentarians participating in the CPI on June 6th.

The sports betting CPI has been trying, since last week, to call for defender Eduardo Bauermann, formerly of Santos, and midfielder Romário, formerly of Vila Nova, to be heard by the committee at the meeting that takes place today (13). Meanwhile, the former Santos player asks the Federal Superior Court (STF) not to need to testify before deputies.

Until this Monday (12) afternoon, the names of Bauermann and Romário were on the list of deponents of today's extraordinary meeting, which highlighted that the two had not been located. The call for them and about 40 other people to be heard was discussed and approved last week.

The CPI's executive secretary initially looked for both by address and telephone number that appeared in the Chamber's database, but was unable to reach them through. Likewise, although the CPI votes were public, Bauermann and Romário, or their lawyers, did not seek out the Chamber to make themselves available.

In the case of Bauermann, his defense filed a habeas corpus with the STF on Friday (9), asking that he not be compelled to testify, under the allegation that the case is already being investigated in the Justice of Goiás. According to the Supreme Court website, the request was already distributed to Minister André Mendonça earlier this Monday (12) afternoon. However, there was no analysis of the object until the present moment.

In his defense, obtained by the Jovem Pan reporting team and carried out by the lawyer Ana Paula Silva Corrêa, the sportsman argues that there is already an ongoing investigation in Justice and that the presence of Bauermann in the sports betting CPI would promote “illegal embarrassment”.

“In view of the identity of object between the verification made by the Chamber of Deputies and the ongoing judicial process, the summons made by the Parliament, by itself, characterizes a manifest illegal embarrassment. […] After all, he will be asked to testify about the same facts that are imputed to him in the criminal judicial area and, what is worse, even before they pass through the scrutiny of due legal process, which is a great absurdity,” he pointed out.

For the CPI secretariat, the next step will be to activate the Legislative Police (Depol) so that, if necessary, it activates the Federal Police and the two are coercively taken to the CPI for testimony. But this alternative should only be considered after the start of the meeting in which they are expected, this Tuesday. As summoned, they do not have the prerogative to refuse to go to the CPI.

This will be the second meeting of the CPI with hearings, after the first with the president of Vila Nova, who denounced the match-fixing scheme, and two representatives of the Public Ministry of Goiás.

This time the meeting's theme is "Manipulation of results in the state of Goiás", and will hear leaders of Goiás football, among them the president of the Goiás federation, Ronei Ferreira de Freitas, a former president of the union of referees, Cleyton Pereira dos Anjos, and the president of the players' union, Júlio Cesar Garcias. Júlio César Motta, president of the state arbitration commission, explained his absence.

After the public hearing, the collegiate will discuss and vote on 15 more requests for invitations and summons, among them Robson Barreirinhas, secretary of the Federal Revenue, Roberto Campos Neto, president of the Central Bank, Ana Moser, Minister of Sports.

Among the requirements that will be analyzed are some managers of sports betting houses operating in Brazil:

  • Denise Coates (partner of bet365).
     
  • Alexandre Fonseca (director of Betano) and the partners of Betano's service providers, namely: Leonardo Lacerda Montenegro Chaves, Filippos Georgios Antonopoulos and Rafael Lavezzo dos Santos.
     
  • Kimberley Daly and Gustavo Silva (executives of Betfair) and André Luís Friaca Rodrigues (partner of the company that provides services to Betfair).
     
  • Ernildo Júnior Farias, partner at Pixbet.
     
  • Maksym Tsaryk (partner of Parimatch) and the partners of Parimatch's service providers, namely: Edson Antônio Lenzi Filho Thiago Heitor Presser (partners of the payment method company Paybrokers).
     
  • João Studart, CEO of NSX Group Betnacional.
