New Lotesul is still challenged at STJ but Mato Grosso do Sul governor does't give up on the project

The State Government's attempt to resume Lotesul's operation after 15 years collided with an appeal decision by the STJ (Superior Court of Justice). The call notice released in August 2022 was contested. Decisions of the first and second instance, in Mato Grosso do Sul, upheld the request of NGT Brasil Tecnologia, from Paraná state, and Activities Lotericas LTDA.

Interested in exploring the service, the lawyers filed a writ of mandamus against the announcement, pointing out that the government did not launch a tender to choose just one company, but a public call in which several could meet the requirements.

Another argument is that the State has set only one quota, authorized for each group of 2 million inhabitants. That is, there would be no judgment of proposals, but preference for those who were accredited first, which would not be supported by law.

The company also pointed out that the call would allow subcontracting by those who won the exploration of the games. Therefore, the lawyers ask for the annulment of the notice, due to the incompatibility of using accreditation as an unenforceable bidding modality.

In a note, Sefaz (Secretary of State for Finance) stated that it will maintain the public notice until the possibilities of resources are completed. "Thus, it will be necessary to await a final decision for the exploration of the services."

Questioned about the Lotesul situation, Governor Eduardo Riedel (PSDB) stated that he will not give up on resuming the lottery operation. “It is an important action. Everything that increases collections is for the good of the State and will be done with strict rules,” he justified.

Since 2021, R$ 146,000 (US$ 30,500) of additional credits have been committed to comply with the Lotesul law, but due to the judicialization, the public notice is still 'locked' and with no forecast of resumption. The service operator should be recognized in September last year.

With that, nine months have gone by without the legislation getting off the ground. It is worth mentioning that part of the lottery money will be used to increase public revenues that will finance social security and other social demands.
