CAIXA publishes new circular regulating lottery permits

Caixa Econômica Federal has just published Circular 1,010/2023 in the Union’s Official Gazette (DOU), in which it regulates lottery permits throughout Brazil. It defines the rules for the entire network, forms of permission, rights and duties of concessionaires and the modalities currently being sold.

Circular 1,010/2023, published by Caixa Econômica Federal last Friday (21st), defines and updates the rules for lottery operations in Brazil, pointing out the rules for the sale of lotteries in Brazil, forms of permission and rights and duties of concessionaires, in addition to explaining the equipment to be used in the lottery network – both those intended for the sale of federal lotteries and those focused on the provision of bank correspondent services.

The circular also defines the operation via PIX, in which the customer can pay their bets through the instant payment created by the Central Bank, as well as receiving change in cash and withdrawals at lottery outlets.

The document defines the lotteries currently commercialized, such as the ticket lottery, numerical predictions, sports predictions (in which the player indicates his predictions on the results of sports competitions), and the specific predictions (Timemania). In addition, the circular makes it clear that “CAIXA may launch, at any time, other types of lotteries not provided for in this Circular.”

The rules contained in the new CAIXA Circular also define the categories of lottery units, divided into:

  • LOTTERY STORE – legal entity dedicated to lottery activity, granted through bidding;
     
  • LOTTERY STORE ADVANCED TEMPORARY – extension of LOTTERY STORE for marketing all types of lotteries and authorized to meet seasonal demand or public interest;
     
  • SIMPLIFIED LOTTERY UNIT – unit that is characterized by being installed in locations whose market potential is considered insufficient for opening the LOTTERY STORE category;

The Circular also defines the fixed network ticket sales network and street ticket sales (discontinued mode).

All remuneration on the provision of lottery services as well as banking correspondents is explained in the Circular, with the definition of commission on the sale of lottery products, sweepstakes and banking services.

The document also deals with the way of selecting new permit holders, always through bidding, as well as making it clear that the definition of places of interest is up to CAIXA, “observing the sales potential of federal lotteries and the demand for serving the local population, through technical studies.”

In addition, it defines the physical formatting of the store intended exclusively for lottery activity, with sizing based on Brazilian technical standards, regulatory standards of the Ministry of Labor and criteria of ergonomics, eco-efficiency, environmental comfort, accessibility and functionality of the services performed. The document also addresses the visual and environmental standardization of all stores.

The Circular also defines a system for assessing the performance of concessionaires and defines that CAIXA provides all assistance and consultancy for training professionals in the lottery network, as well as the correct way of using equipment, systems, security and microcomputers in the lottery network.

Annex I of the Circular deals with the registration fee, bid, tariffs and fines, in addition to the cost of administrative expenses that involve the network's relationship with CAIXA, in addition to points for relative administrative sanctions more explained in Annex II.

Annex III deals with the PIX operation, both for the payment of lottery bets and banking services using the instant payment system created by the Central Bank, giving the prerogative to the network to serve as a withdrawal agent for customers, as well as the PIX change, in which the customer uses the PIX for the purpose of change.
