Provisional Measure 1,182 brings a series of changes. Some important points:
The revenue of betting companies will be taxed at 18%, levied on the GGR (Gross Gaming Revenue). The amount collected will be allocated as follows:
Charge of 30% Income Tax on prizes. Gains of up to R$ 2,112 remain exempt from income tax.
In accordance with the Provisional Measure in force, the participation in sports betting of the following categories of people is expressly prohibited:
Based on current legislation, companies that conduct betting activities without proper authorization from the Ministry of Finance or that, even with the concession, offer the service in disagreement with the legal provisions, will be subject to penalties.
The fines applied may vary from 0.1% to 20% of the total amount collected by the company, limited to R$ 2 billion per infraction committed. Furthermore, the operating license may be revoked and the company's operations suspended.
The PM is already in force, but must be analyzed by the National Congress within a period of up to 120 days.
The market is now awaiting the publication of the Bill that will determine more rules for the operation of betting companies in Brazil.
