Loterj adjusts edict for sports betting operation to comply with Brazilian government’s PM

Loterj published in today's (27th) Official Gazette that Accreditation Notice 01/2023 has been amended to comply with the Provisional Measure (PM) that regulates sports betting in Brazil. The company will authorize “other activities on the betting platform, including games of strategy, skill, electronic and activities that do not characterize lotteries or unauthorized gambling, provided that they are compatible with federal and state legislation.”

Aware of the changes in federal legislation due to the edition of Provisional Measure 1.182/2023 that regulates sports betting in Brazil, Loterj published this Thursday (27th), a new Public Notice for the accreditation of those interested in operating in Rio de Janeiro.

In item 3 of the new Notice of Loterj, it states that:

“3. Item 2.1.1 is added to the Notice, with the following wording: “The Accredited may explore other commercial activities on the betting platform, including strategy games, skill games, other electronic games and activities that do not characterize lotteries or unauthorized gambling, as long as they are compatible with federal and state legislation and with the main object of the Accreditation Term.”

In general, the new Notice follows the permissions and prohibitions indicated in the federal Provisional Measure, including with regard to the requirements for operators to adopt “security and integrity mechanisms in carrying out any lottery modalities; and that, for sporting events subject to fixed odds betting, it will adopt actions to mitigate match-fixing and corruption in actual sports-themed events, in compliance with the provisions of art. 177 of Law No. 14,597/2023 and the best national and international practices regarding the prevention of these practices.”

The new Loterj document added item 7.1.4.k, which requires those interested in operating sports betting in Rio de Janeiro: “Declaration that it integrates or will integrate, within a period of 180 renewable days (upon proof of prior engagement in a commitment to integration or equivalent), a national or international body for monitoring sports integrity.”

At the same time, it determines future operators to implement a “Responsible Gaming program, with the actions carried out, in order to protect gamblers with gambling disorders, as well as promote informative actions to raise awareness of gamblers and prevent pathological gambling disorder, through the elaboration of codes of conduct and the dissemination of good practices; and will respect any restrictions and guidelines for communication, advertising and marketing actions for the fixed-quota lottery set up by the Union, by the State of Rio de Janeiro or by the National Council for Advertising Self-Regulation – Conar.”

In the new Public Notice, Loterj informs that “The Public Accreditation for exploration and development of the Lottery Services object of this Public Notice will be open and available for qualification requests until 6:00 pm of the 15th (fifteenth) consecutive day following the publication of this Amended Public Notice, date on which will be closed.”

Considering the publication on this date (July 27, 2023), those interested in obtaining accreditation with Loterj have until August 11, 2023 to present themselves to the body.
