Court freezes balance of 'Bet' account to pay bettor's debt to the bank

The Court of Justice of São Paulo ordered the seizure of funds from a bettor deposited in ten active accounts on ‘Bets’ to pay a debt with Santander. The case involves the owner of a transport company who owed R$719 (US$ 128) to the bank, a payment that had been pending for three years. To enforce the sentence, the Court of Justice found that the businessman had balances on betting sites and ordered the funds to be frozen.

According to the lawsuit, the search for the amounts available in the accounts was only possible because the betting houses were regularized by the government. The businessman appealed and there has been no decision yet.

According to experts, the freezing of accounts in 'Bets' sets a precedent because, like current accounts in banks, brokerages and real estate, the Judiciary now considers the betting sites as another source of resources.

According to lawyer Sérgio Pelcerman, a partner in the labor law department at Almeida Prado Hoffmann Advogados, as the regulation of 'Bets' moves forward in the country, more creditors will be expected to include the blocking of betting accounts in their requests.

"What should happen next year is that 'Bets' databases will be included in the Judiciary's search system and any amount invested, or that indicates any type of profit, will directly result in execution," says Pelcerman.
