Sites licensed in Rio de Janeiro may continue to operate regardless Finance Ministry's list

Concerned with clarifying to users of betting houses accredited by Loterj whether or not the service will continue to be provided in light of the list of ‘Bets’ -as operators are called in Brazil - authorized by the Ministry of Finance, the agency issued a statement on the subject. The court's position in favor of the company allows its licensees to continue operating throughout Brazil in accordance with Rio de Janeiro's rules.

In addition to the list released by the Prizes and Bets Secretariat of the Ministry of Finance, fixed-odds betting sites accredited by Loterj may continue to operate throughout Brazil.

Loterj regulated in April 2023, based on what the Federal Supreme Court (STF) decided in ADPF 492, and on Paragraph 8 of art. 35-A of Law 14.790/2024, which guarantees Loterj's position.

On this subject, the Federal Regional Court (TRF1) granted an injunction to Loterj, emphasizing that the Ministry of Finance's ordinances dealing with the subject invaded the regulatory competence of the states and exceeded the federal competence, as established by the Federal Constitution and by the STF itself.

Since June of last year, several 'Bets' have been accredited by Loterj to operate after participating in the Accreditation Notice, paying the grant of R$5 million (US$ 918,000) for a period of up to five years of operation and bearing the federal fees and taxes to the Union on a monthly basis.
