Finance Ministry updates list of ‘Bets’ that can continue operating in Brazil until end of the year

The Secretariat of Prizes and Betting (SPA) of the Ministry of Finance updated this Tuesday (8) the list of companies, with the brands and domains in which they will be able to explore fixed-odds bets in Brazil until December 31, 2024 (national list). There are now 96 operators with 213 ‘Bets’. The state lists have 18 companies and 23 websites.

The inclusion of companies in the national list occurred after clarification of issues identified during the authorization process and, once resolved, they allow them to be considered as companies in a period of adaptation, under the terms of Ordinance SPA/MF No. 1,475, of 2024.

In addition, the SPA updated the list of legal entities authorized by states to explore fixed-odds bets, within their territories, under the terms of art. 35-A, of Law No. 13,756, of December 12, 2018, whose brands and internet domains have been reported to the Ministry of Finance, to date.

The lists were created based on SPA-MF Ordinance No. 1,475, with the objective of considering in the adaptation phase to the new rules created by the Ministry of Finance only those companies that requested authorization to operate sports betting and online games until the date of publication of the ordinance.

Sites that are not on the list released by Finance can no longer offer bets, nationwide. They will remain online only to facilitate the request for return, by bettors, of the money deposited in their names with these companies.

As of October 11, these sites will begin to be taken down, with the assistance of the National Telecommunications Agency (Anatel). Even after this date, it will continue to be the responsibility of the site operators to ensure the means for bettors to withdraw the deposits to which they are entitled.

The SPA-MF will be responsible for monitoring and adopting the measures necessary to comply with the new ordinance, in coordination with other authorities with the authority to prevent any infractions that may be committed.

At the end of this transition period, which will last until the end of this year, the SPA-MF will release the final list of companies and websites that will be authorized to operate as of January 1, 2025, when the regulated betting market will begin in Brazil. First, the requests submitted by August 20 are being analyzed.

Only companies that comply with Law No. 13,756/2018, Law No. 14,790/2023 and the more than ten regulatory ordinances created by the Ministry of Finance this year will be able to operate next year. These include rules to combat fraud, money laundering and abusive advertising, among others.

Before that, later this year, the first companies that are definitively approved will have to pay a grant of R$30 million (US$ 5.4m) to begin operating. Each request for authorization/payment of a concession fee entitles you to up to three 'Bets' - as the operators are called in Brazil. Companies that wish to request the release of more than three brands must make more than one request and will have to pay more than one concession fee.

Next year, betting houses that are definitively authorized will be required to use websites with the extension bet.br. Requests received after August 20 will then be analyzed.

Up until the date of publication of the last ordinance, on September 17 of this year, the SPA received a total of 117 requests from 112 companies. They had until 11:59 pm last Monday (9/30) to inform the Treasury of the commercial brands ('Bets') that are in operation and which websites (internet domains) they intended to use during this adaptation period, so that the Finance could compile the lists that were released.

Those who requested authorization but were not yet operating will have to wait to start operating in January, if they obtain authorization from the Ministry of Finance, upon fulfilling all the requirements.

New authorization requests can be submitted at any time. The SPA-MF has up to 150 days to respond.
