The purpose of the precautionary measure issued by the National Consumer Secretariat (Senacon), linked to the Ministry of Justice, is to monitor “the online gaming and betting market regarding bonuses and advertising of betting games to prevent and combat over-indebtedness and also ensure the safety of vulnerable individuals in consumer relationships, with special attention to hyper-vulnerable individuals such as children and adolescents.”
The measure determines:
1 – Suspension throughout the national territory of any advertising of rewards related to advance payments, bonuses or prior advantages, even if for the sole purpose of promotion, publicity or advertising, for placing bets;
2 – Suspension throughout the national territory of any advertising of fixed-odds online betting games for children and adolescents;
3 – Submission, within 10 (ten) days of notification of the precautionary decision, of a transparency report on the measures adopted to comply with the respective suspensions.
Companies in operation authorized to operate fixed-odds bets, both nationally and statewide, must comply with the determination, according to the list published by the Prizes and Bets Secretariat of the Ministry of Finance.
Failure to comply with any of the measures listed will subject interested parties to a daily fine of R$50,000 (US$8,700) for non-compliance, which will be applied until the measure is fully complied with.
