Contrary to what the Secretary of Prizes and Betting, Regis Dudena, said that the list of approved companies would be released by the end of December, on Tuesday (19) night the SPA began communicating directly to companies about the presentation of proof of payment of the concession fee of R$30 million (US$ 5.2m), proving that they have paid-in capital of R$30 million and a declaration of the lawful origin of this share capital.
Companies have up to 30 days to present the documentation and if they do not do so, their license application will be archived.
From what GMB has learned, Entain, with its Sportingbet brand, was one of the first to receive the notification, as well as Betsson, Flutter, Rei do Pitaco, MGM LeoVegas, Betnacional and Kaizen (Betano).
SPA Notice to Companies:
“Dear Legal Representative,
In compliance with item I of the caput of art. 16 of SPA/MF Ordinance No. 827, of May 21, 2024, the Prizes and Betting Secretariat of the Ministry of Finance notifies the requesting legal entity to:
1) present proof of payment to the National Treasury's Single Account of the amount of R$30 million (thirty million reais) by act of authorization, pursuant to art. 17; and
2) present the evidence referred to in items II to VI of the caput of art. 14.
The documentation related to items 1 and 2 above must be submitted within thirty days, counting from the date of this notification, in compliance with the guidelines contained in SPA/MF Report No. 0002/2024.
It is important to emphasize that failure to comply with the thirty-day deadline for submitting proof of payment for item 1 – payment for the authorization grant – will result in the definitive filing of the authorization request. This deadline is non-extendable, according to art. 13 of Law 14,790.
In the event of failure to comply with the deadline for submitting proof of payment for item 2 – items II to VI of the caput of art. 14 – the authorization procedure will be suspended according to art. 14, § 3.
