The transfer of data and resources from bettors registered with the sending legal entity to the receiving legal entity may only be carried out between bets of the same economic group.
To receive data and resources from bettors registered with national or foreign legal entities of the same economic group, which operate the fixed-odds lottery betting modality in the national territory, they must request approval from the Secretariat of Prizes and Betting of the Ministry of Finance.
The ‘Bet’ – as operators are called in Brazil - receiving the data and resources must formalize the request for approval to the SPA by filling out specific requirements and sending them through the Electronic Information System of the Ministry of Finance.
The transfer of data and resources approved by the Prizes and Bets Secretariat of the Ministry of Finance must comply with the following requirements:
I - the transfer of data and resources to the receiving legal entity must have been previously and expressly consented to by the bettors of the sending legal entity;
II - the identification and registration of bettors in the sending legal entity must comply with the provisions of Ordinance SPA/MF No. 722, of May 2, 2024, and Ordinance SPA/MF No. 1,231, of July 31, 2024;
III - the data transferred to the receiving legal entity must be stored and processed in compliance with the rules of Ordinance No. 722, of May 2, 2024; and
IV - the resources of each bettor must be duly identified in the sending legal entity and in the receiving legal entity by the holder's registration number in the Individual Taxpayer Registry - CPF.
Bettors will be guaranteed the right to choose between:
I - withdraw the funds in their name by sending them to one of their accounts registered with a financial or payment institution authorized by the Central Bank of Brazil; or
II - authorize the transfer of the funds in their name to a transactional account in the receiving legal entity, with the respective registration in the graphic account.
‘Bets’ that have not requested authorization to operate sports betting and online games by September 17 will not be able to make transfers between companies in the same economic group.
The Ordinance also determines that companies that have not obtained a license to operate sports betting and online games must close all open bets by December 31, 2024, transferring the available funds to the checking account registered on the platform by bettors.
If the bettors have not indicated an account to receive the funds and after the company has attempted to return the funds by March 31, 2025, all funds must be returned to the Student Financing Fund and the National Fund for Public Disasters, Protection and Civil Defense.
