The responses have already started to be sent out in an ordinance published in the Official Gazette to the companies that submitted their requests by August, the deadline set by the Ministry for those who wanted to start operating regularly by 2025.
“The companies that requested in this first batch have already started to be notified,” says the Secretary of Prizes and Betting of the Ministry of Finance, Regis Dudena, in an interview with InfoMoney.
As established by the ordinances published throughout the year, from this notification onwards, companies have a deadline to comply with the final requirements. These are mainly financial compliance issues, such as the full capital contribution of R$30 million (US$ 5m), payment of the concession fee and the creation of a reserve of R$5 million (US$ 832,000).
“So far, we have only notified those [bets] that have complied with all the requirements, so those that have not yet complied have not been notified,” says Dudena.
“We are evaluating those that will, in fact, simply be denied because they did not comply with the requirements and those that may need to make some additional requests.”
For now, the secretariat is not disclosing how many notifications have been issued.
As soon as the government checks all the documents declaring the origin of the funds to ensure compliance with the adjustments, it will publish the complete list of companies authorized to operate from 2025 onwards.
According to Dudena, who was at a CBF Academy event in São Paulo this week, the profile of companies that requested authorization more promptly is different from later groups, which impacted the flow. “We noticed that there is a certain difference in the quality of the initial requests compared to those that came later, but all requests must be analyzed in detail.”
More than 300 requests were submitted, and not all of them were received by the August deadline. Companies that already operate in Brazil and missed the deadline will have to end their betting offers early next year and wait for their authorization to be issued.
Starting in January, the Secretariat has a three-year period to analyze the results of the regulation and its effects. “If necessary, we can bring it forward, but the expectation is that this cycle will occur within the scheduled timeframe,” said Dudena.
