Goiás takes legal action against 251 ‘Bets’ for lack of warning about risk of gambling addiction

Goiás has taken legal action against 251 companies that operate in sports betting and iGaming. The state Public Prosecutor's Office is asking that the platforms be required to include, on their web pages, 'clear and precise warnings and notices about the dangerousness and harmfulness of the product/service provision,' in a space of at least 20% of the main screen and in all sections/game modes.

A 15-day deadline must be set for these measures, under penalty of suspension of the activity on the internet, in addition to the advertising of the product on television or any other media.

The ACP (public civil action) includes a request for a precautionary measure (provisional decision), with the purpose of anticipating the effects of a possible sentence favorable to the Public Prosecutor's Office. The targets of the ACP are all 'Bets' (as the operators are called in Brazil) registered with the Ministry of Finance, through the Secretariat of Prizes and Betting (SPA).

The MP from Goiás also wants the Court to order 'Bets' to display on their websites, via pop-ups (windows that open in the internet browser), the message "gambling can cause gambling addiction, disorders, addictions, over-indebtedness, in addition to adverse consequences.

According to prosecutor Élvio Vicente da Silva, the civil action aims to create a safer and more responsible environment for consumers. "It is an essential milestone to protect the dignity and financial and emotional health of the population", he said.

Among other requests, the prosecutor also proposes that the Court require bets to provide "total transparency" to consumers about the amounts collected from bets, indicating the individual transaction of each modality, and to keep, in a digital file, for a minimum period of five years, the entire history of the relationship between the bettor and the company.
