Lottopar disputes possible tax war among states in betting regulation

The publication of a report by Veja about a potential tax war among states in the regulation of sports betting prompted Lottopar to issue an official clarification on the matter. Paraná was mentioned as one of the first states to regulate betting, and the president of the authority, Daniel Romanowski, stated that the entity simply took the lead and did not seek, nor seeks, confrontation between federated entities or with the Union. "Lottopar clarifies that the Government of Paraná created the Loterias do Estado do Paraná to regulate and oversee lottery operations and to be a new source of revenue, envisioning a new source of income for investments in social areas and projects. This decision by the state reflects the decision of the Supreme Federal Court (STF) on September 30, 2020, to break the Union's monopoly on lottery exploitation.

All stages, from the creation of Lottopar, by Law 20,945 of December 20, 2021, through regulation by State Decree 10,843/2022, to the Call for Lottery Operator Accreditation, were carried out in accordance with the law. Always respecting legal norms and aiming for maximum transparency and security for the Paraná lottery market.

The Authority held a public hearing in 2022 for contributions from society for the operation of fixed-odds betting services, and then published Accreditation Call 001/2023 for the granting of fixed-odds betting, widely publicized. At this point, we emphasize that all companies interested in the concession that met all the requirements of the notice would be eligible to operate exclusively in the territory of Paraná.

Since 2018, when then-President Michel Temer sanctioned Law 13,756/2018, some states have been awaiting an initiative from the Federal Government for market regulation, which is still pending. Paraná began to advance in the regulatory process, creating rules and attracting sector companies to invest in Paraná.

At no time did we demand payments as mentioned in the article; we simply conducted our accreditation opening process through a notice widely disseminated, with lottery companies interested in working within the limits of the state of Paraná, as permitted by law. The mentioned values ??refer to the concession fee, a license payment for these companies to operate in Paraná, granted for a period of five years.

We have no provision prohibiting marketing, so far, in state legislation. We also have no interest in companies that exploit the Paraná market in a regulated manner, either statewide or nationally, being prohibited.

Here in Paraná, with a conservative stance, with legal security and legally based on laws and decrees, we are advancing little by little. Following international security rules and best practices in this segment, including widely promoting good practices in responsible gaming and safe gaming.

We understand that there will be interested companies with appetite for state markets and the national market. And that these may compete and coexist harmoniously.

We are not adversaries of the Union; on the contrary, we very much hope that the market will be regulated as soon as possible, thus seeking greater legal security for the entire lottery market, more security for bettors, and social returns for the entire population.
