The Secretariat of Prizes and Betting of the Ministry of Finance published this Monday (26) the first ordinance of a set of 14, to begin in practice the licensing process for the operation of sports betting and online gambling in Brazil.
Ordinance MF-SPA/MF No. 300 is intended for the accreditation of sports betting and online gaming certification laboratories. It establishes the requirements and procedures relating to the recognition of the operational capacity of entities certifying betting systems, live gaming studios and online games to be used by fixed-odd betting lottery operators.
The ordinance defines:
I - Certifying entity: a legal entity with recognized operational capacity by the Ministry of Finance to test and certify equipment, programs, instruments, and devices comprising fixed-odds betting systems, live game studios, and online games used by fixed-odds lottery betting operators, subject to the technical requirements established in specific regulations;
II - Betting system: computerized system managed and provided by operators to bettors, enabling registration of bettors, management of their virtual wallets, and other functionalities necessary for the management, operation, and commercialization of fixed-odds bets;
III - Operating agent: a legal entity authorized by the Ministry of Finance to operate fixed-odds betting lotteries;
IV - Critical components: any component where failure or compromise may lead to the loss of bettor rights, loss of Union revenues or legal recipients, prevention or difficulty of regulator access to operational information, unauthorized access to betting system data, or non-compliance with regulations governing fixed-odds betting operation in the country;
V - Online gaming: an electronic channel enabling virtual betting on a game where the result is determined by the outcome of a future random event, based on a random number generator, symbols, figures, or objects defined in the rule system; and
VI - Live game studio: a physical environment that uses live video transmission technology to provide live online games to a remote gaming device integrated into the betting system, allowing the bettor to participate in live games, interact with game attendants, and other bettors.
The ordinance specifies for items V and VI that fixed-odds bets may only concern online games or virtual events of online games that include a multiplication factor of the bet value defining the amount to be received by the bettor in case of winning.
Recognition request
Laboratories must submit to the Secretariat of Prizes and Betting an application for recognition of their operational capacity as a certifying entity for betting systems and live game studios and online games used by sports betting operators.
The ordinance lists, in its annex II, the documents that laboratories must submit to obtain recognition and include legal qualification, proof of tax and labor regularity, proof of integrity, and technical qualification, both for Brazilian and foreign companies.
Annex VI indicates the certificate models to be issued by laboratories accredited by the Secretariat of Prizes and Betting. They are:
1. Betting System
2. Sports Betting
3. Online Game
4. Integration
5. Live Game Studios
The certificates issued must include, among other data, information about the certifying laboratory, indicate the Secretariat of Prizes and Betting of the Ministry of Finance as the recipient of the report, outline the technical requirements for conducting tests and certification, specify the supplier of the evaluated system, detail which products were tested, provide test results, elaborate on the tested software, identify the software and game supplier, and include the certificate reference number, among other details.
The laboratory must provide explanatory notes detailing the tests conducted, as well as the context considered for verification and any other information necessary for understanding by the regulator.
For live game studios, the laboratory must also provide details of what was tested in the studio, including its location and which games are offered, as well as the period during which the tests were conducted. The report should also indicate which items were subject to testing (security, liability, synchronization, personnel, and facilities).
