Deputy asks Chamber to hold public hearing to discuss taxes on iGaming in Brazil

Federal deputy Mário Negromonte Jr. has just filed a request for the Chamber's Finance and Taxation Committee to hold a public hearing to debate the taxation of iGaming in Brazil. He claims that with the enactment of Law 14,790, bets will start collecting taxes from April onwards, which is not true as the companies do not yet have authorization from the Ministry of Finance to start operations.

The opposition of some parliamentarians who are against the gaming sector has another chapter. Although Law 14,790, which regulates sports betting and online gambling in Brazil, defines parameters for taxation of companies that will explore the activity in the country, federal deputy Mário Negromonte Jr., did not give up.

He presented Request 15/2024 to the Finance and Taxation Committee (CFT) of the Chamber of Deputies to debate the taxation of iGaming in Brazil.

Negromonte wants to hear from representatives of the Ministry of Finance and some sports betting companies, such as bet365, Betano, Pixbet, Sportingbet, VaideBet, MarjoSports, Pingolpara and galera.bet.

Furthermore, in his application he also requests the presence of the National Association of Games and Lotteries.

In his justification, the deputy states that “it is necessary to continue the discussion on the taxation of this type of service” (sports betting and online games).

He admits that “most of the rules are already in force, but the part relating to taxation on betting will come into effect in April. Other rules still depend on government regulation.”

By stating this in his justification, the parliamentarian demonstrates lack of knowledge about the rite of initiation of taxation, considering that to date the license request process has not been opened and that only after approval by the Ministry of Finance will companies begin to operate under authorization and, only from then on, will they begin to collect the taxes determined by Law 14,790.

The Law determines that the grant will cost up to R$30 million (US$ 6m) for a period of five years for up to three brands per operator. To operate in Brazil, bets will have to pay 12% tax on GGR, in addition to other taxes related to any economic activity, such as PIS, Cofins and ISS. In addition, they will pay an inspection fee depending on the volume of sports betting sales.

The request awaits deliberation in the Chamber's Finance and Taxation Committee, which has a meeting scheduled for this Wednesday, 20th. The request is the seventh item on the agenda.
