In October 2021, Law 8,902 allowed the State Executive Power to directly provide, or under a concession or permission regime, the public lottery service in the state. The new text approved by the Legislative Assembly of Sergipe (Alese) authorizes Banese to operate the service, as well as taking other measures.
Proposed by the State Government, the Bill aims to finance actions focused on culture, the environment, inclusion and social assistance, as well as reducing the socioeconomic vulnerability of the people of Sergipe.
Furthermore, the measure is another action by the Governor of Sergipe, Fábio Mitidieri, to strengthen the state bank, making it even more solid, sustainable, and close to the population.
For the implementation of the lottery, the Bill determines that the bank may choose to create a subsidiary, a holding company, or participate in a corporate structure to exploit such services. The oversight of these new services will be the responsibility of the Regulatory Agency for Public Services of the State of Sergipe (Agrese).
"Banese has a significant presence throughout the state, either through its branches or through Banese Points. The implementation of a state lottery through a bank with its credibility and importance to the Sergipe economy diversifies its services while building a new form of revenue for specific areas of the state," highlighted State Deputy and government leader in Alese, Cristiano Cavalcante.

Author of the recommendation proposing to the State Government the regulation of the public lottery service in Sergipe, the licensed state deputy and current State Secretary-Chief of the Civil House, Jorginho Araujo, explains that Law 8,902, of October 6, 2021, already established the right of the state to adopt initiatives to enable its respective provision of lottery services according to its own criteria, eventually different from that adopted at the federal level for lottery operation.
"In September 2020, the Supreme Federal Court (STF) ruled the exclusive exercise by the Union of lottery activities to be unconstitutional. The former monopoly can now be exercised simultaneously by the States, with them managing their own lotteries, applying the same rules already used by the Union," emphasizes Jorginho Araujo.
According to him, currently, lottery revenue revolves around 0.2% of GDP, compared to a global average of 1%. "With this growth potential, considering also the state GDP, only the Government of Sergipe could collect, per year, around R$ 480 million (US$ 96 m). Surprisingly, without having to impose any new taxes on the population or any other economic activity," Jorginho adds.
