CBF determines that Bets can only display brands on uniforms if comply with Law 14,790

The Brazilian Football Confederation (CBF) published the new General Competition Regulations (RGC) of 2024, with news regarding the betting market. From now on, Bets will only be able to stamp brands on uniforms if they meet the requirements of Law 14,790 that regulates the sector. Operators will only be able to insert, on their platforms, matches from competitions organized and coordinated by the CBF with prior authorization from the highest Brazilian football entity.

The Brazilian Football Confederation (CBF) published on Friday (12) the General Competition Regulations (RGC) for 2024. The document establishes the norms and general rules for the dispute of all championships organized by the entity this season. In addition to the RGC, each competition has its Specific Regulations.

According to Article 114 of the RGC 2024, the display of betting house brands on club uniforms "is conditioned to compliance with the requirements provided for in Law No. 14,790/2023 and in the regulation of the Ministry of Finance."

The text also provides that the CBF may prohibit, at its discretion, "the dissemination of advertising or propaganda by a company not aligned with the entity's policies or that is involved in any operation suspected of economic infractions or ethical violations."

The Sports Betting Law came into force on December 29, 2023, but the Ministry of Finance Ordinance instituting a Regulatory Policy of the Prizes and Betting Secretariat (SPA) was only published last Wednesday (10/4).

In the new RGC, the CBF explains that it "may request the production of a report by a specialized company in the detection of match-fixing, as well as a technical opinion on the sporting conduct of those involved."

What the new CBF RGC says regarding sponsorship from betting houses:

Article 114 – The display of advertising or propaganda by companies, national or foreign, sports betting operators, in any form, including on the uniforms of participating teams, is conditioned to compliance with the requirements provided for in Law 14,790/2023 and in the regulation of the Ministry of Finance.

§ 1 - Clubs and sports betting operators may only include, in their platforms, matches of competitions organized and coordinated by the CBF with prior authorization from the CBF and, in State Competitions, with the authorization of the respective State Federation organizer.

§ 2 - Sports betting operators, for the display of advertising or propaganda in competitions organized and coordinated by the CBF, must present a declaration of non-involvement of the company or any of its collaborators in any economic infraction or ethical violation related to match-fixing, renewed annually. The CBF will provide the standard declaration form to be sent by the clubs, which, in turn, must send it to the sports betting operators, to the Integrity Unit ([email protected]).

§ 3 - The CBF may prohibit, at its sole discretion, the dissemination of advertising or propaganda by a company not aligned with the entity's policies or that is involved in any operation suspected of economic infractions or ethical violations.

§ 4 - Only sports betting operators duly authorized by the Ministry of Finance, in accordance with Law No. 14,790/2023, may be authorized to carry out advertising in competitions organized by the CBF.

§ 5 - The display of advertising or propaganda by a sports betting operator, in violation of the provisions of this article, shall subject the club to the payment of a pecuniary fine, in an amount to be fixed by the Presidency and in accordance with these RGC.
