Loterj reopens deadline for Bets to be regularized in Rio de Janeiro

Sports betting and online gaming houses have a new opportunity to regularize themselves. The Rio de Janeiro Lottery opened for another 30 days, starting from April 12, to be accredited. The information was published in the Official Gazette and posted on the municipality's website. At Loterj, the first lottery to accredit sports betting operators (known as Bets) in the country, the fixed grant value is R$5 million (US$ 1m) and the tax is 5% on the GGR.

Due to high demand from national and international companies seeking accreditation, Loterj has reopened the deadline for new betting houses to operate legally in Rio de Janeiro.

The company reports that in just the last few days, 13 new sports betting houses have expressed interest in accreditation.

The reopened call for proposals aims to accredit companies for the development and operation of public lottery services for up to five years, in accordance with the requirements and within the limits and conditions stipulated by the call for proposals.

Accreditation will be for commercial operation in a virtual environment, with online access on personal devices or using mobile applications (Apps), web, VLT (Video Lottery Terminal), POS (Point of Sales), or Terminals/Kiosks, exclusively in a competitive environment, for the lottery category 'Fixed Odds Sports Betting, related to real sports-themed events', as provided by current legislation.

Already in operation are the betting houses Apostou RJ, Bestbet, MarjoSports, and Pixbet. Nine others are currently undergoing accreditation (1xBet, Caesars Sportsbook, Key Solution Gaming of Bet, Lottoland, Lema, Laguna, PNR, Purple & Green, and SDL Loterias).

On April 5, Loterj responded to the directive from the Secretary of Prizes and Betting to cease the sale of sports betting throughout Brazil. The agency stated that territoriality cannot be extrapolated for a virtual service modality and that it complies with the decision taken by the Federal Supreme Court authorizing the operation of state lotteries.

In response to the Secretary of Prizes and Betting, Loterj stated that "in the case of a virtual service modality - subject to the discipline of Article 3 of Complementary Law no. 116/2003; and whose consumption, in turn, will always be preceded by unequivocal acceptance and acknowledgment, by the consumer-bettor, of the situation in the State of Rio de Janeiro - there is no trespass, either materially or legally, of state territorial limits, the activity being entirely concentrated - e.g. situated, provided, and consumed - within the territory of Rio de Janeiro, for all purposes".
