Kasznar Leonardos launches guide to unveil advertising rules for sports betting in Brazil

Kasznar Leonardos has just published a complete guide to unveil the advertising rules for sports betting in the new Brazilian market. The intellectual property office's marketing and entertainment law team developed the document based on Law 14,790, which regulates the sector, and Annex “X” of Conar, which defines how advertising in the iGaming sector should be.

The Marketing and Entertainment Law team at Kasznar Leonardos has developed a unique material on the main aspects of Brazil's current legislation and the ethical guidelines established by the National Council for Self-Regulation of Advertising (Conar). In the guide "Rules for Advertising Betting", topics such as restrictions, prohibitions, and specific marketing and advertising regulations for the sports betting and online gaming sector are addressed.

The guide was produced based on Law 14,790/2023, which regulates sports betting and online gaming in Brazil, and Annex 'X' of Conar, which establishes rules for advertising and marketing in the sector.

In the 22-page document, Kasznar Leonardos highlights that the guide was elaborated to support agencies, advertisers, influencers, and the sports betting market in general, addressing the main themes of the current legislation in the country, as well as the ethical rules instituted by the National Council for Self-Regulation of Advertising (Conar).

The guide explains the definitions for fixed-odds betting, fantasy sports, virtual events of online games, social responsibility, and responsible gambling, among other topics.

In a didactic manner, the guide points out what is prohibited, both by Law 14,790 and by Annex "X". Among the actions that sports betting houses cannot offer are credit facilitation and prior advantages for placing bets. Regarding advertising, the guide warns that under no circumstances can sports betting be presented as an opportunity for social or financial advancement.

Kasznar Leonardos' team also indicates some of the legal determinations arising from the law that regulated sports betting in Brazil, such as the prohibition of gambling by individuals under 18 years old, owners, directors, or individuals with significant influence of the operating agent, among others.

Chapter 3 addresses important issues, such as the clear advertising identification of any disclosure in any medium. The guide indicates that the advertising nature should be identifiable through clear, direct, and objective information for the consumer. It also emphasizes that when the advertising nature is not evident, it should be included in the piece that it is an "advertorial" or "advertising".

Since the guide also addresses responsible gambling, the document reminds that all advertising must contain allusive phrases, such as "gamble responsibly" and "gambling can cause addiction".

The guide ends with the infractions and penalties to be imposed on the sector in case of non-compliance with Law 14,790/2023 and with Conar's final guidelines regarding advertising rules and encouragement to self-regulation of advertising.
