The mayor of Ribeirão Preto, Duarte Nogueira (PSDB), last week vetoed the Bill approved by the City Council that authorized the creation of a public municipal lottery service. The proposal had been approved by the City Council on March 26th.
At the time, the replacement for Bill155/2022 received 15 votes in favor and two against. The proposal aimed to raise resources for social security and financing projects in various departments.
When vetoing the Bill, Duarte Nogueira pointed out the unconstitutionality of the proposal that authorizes the creation of a lottery in the city and that the Federal Constitution limits the exploration of “consortium and draw systems” to the Union.
Furthermore, he recalled that the Supreme Federal Court gave the understanding that only states, and not municipalities, could also explore these services.
“The Bill was careful not to innovate legislatively regarding consortiums and draws, but it still suffers from unconstitutionality, since it intends to adapt federal legislation to the provision of lottery services in the Municipality of Ribeirão Preto,” points out the justification.
Now, the Mayor's veto has been filed with the Legislature, and must be analyzed by the Chamber committees and the plenary, which can accept the veto or overturn it.
